Why it matters for your home
This is your best protection! Without a clear contract, the contractor can change the price midway, deliver poor quality work, or not respect deadlines, leaving you with no legal recourse. A good contract is the foundation for a healthy relationship and a construction site without nasty surprises.
The African context
In our countries, it's very often overlooked or poorly drafted, leading to many disputes, abandoned construction sites, or unexpected additional costs. It's crucial to include clauses about material quality (often counterfeit or substandard), penalties for delays, and a payment schedule linked to the actual progress of the work.
Red flags
- ⚠ The contractor insists on working 'on trust' without a written contract
- ⚠ The contract is very vague about materials, deadlines, or the price of different phases
- ⚠ You're asked for a very large deposit (over 30%) without any clear guarantee in return
- ⚠ The contract does not include any penalties for delays, poor workmanship, or non-compliance
Questions to ask
- 1. "Does the contract include a detailed work schedule and staggered payments?"
- 2. "What are the guarantees on the quality of materials and the workforce used?"
- 3. "What are the penalty clauses in case of delays or construction defects?"

Not directly relevant to the contract itself, but fees for a lawyer to help you draft it can range from a few tens to a few hundreds of thousands of FCFA.
